Austrian woman awarded 29,000 Euro compensation because of medical negligence

Woman awarded compensation after seven year battle against City of Vienna

A woman who lost her son and grandson from carbon monoxide poisoning has been awarded 29,000 Euro in compensation after a carer at a Vienna hospital sent the pair home. Slobodanka Pavlovic, a house janitor, lost her only son and grandchild in 2006 and since then has been fighting for compensation from the City of Vienna. Carbon monoxide from a fuel stove at her janitor flat in the Schellinggasse in Vienna city centre caused the deaths of her son and grandson who were visiting from Serbia. The three of them were taken to hospital via ambulance. The grandmother was admitted to hospital but the other two were sent home without even seeing a doctor.
The court ruled that this had been a case of gross negligence. The father and son went back to the apartment unaware of the carbon monoxide and died as a result. The OAP represented by Johannes Korab attempted to sue for 112,000 Euro in compensation as well as for funeral costs. After an expensive legal battle which went on for seven years Stadt Wien represented by Alfred Boran, Slobodanka Pavlovic was awarded 29,000 Euro. The Oberlandesgericht in a thirty page document said the victims were 50 per cent to blame for their deaths but ordered 29,000 Euro plus interest in compensation to be paid. Slobodanka Pavlovic saw this as a kick in the face: “Alone the legal costs are higher than that awarded by the City of Vienna.”
